TBK madde 315 ve devam\u0131, kiraya verene kira borcunu \u00f6demeyen kirac\u0131ya kar\u015f\u0131 belirli bir usul \u00e7er\u00e7evesinde ihtar \u00e7ekme ve dava a\u00e7ma hakk\u0131 tan\u0131maktad\u0131r. Bu dava, \u00f6yle basit bir i\u015flemden ibaret olmay\u0131p, kanuni prosed\u00fcrlerin titizlikle yerine getirilmesini gerektiren ciddi bir yarg\u0131lama s\u00fcrecini ifade eder.<\/p>\n\n\n\n<h2><span class=\"ez-toc-section\" id=\"Kira_Sozlesmesindeki_Odeme_Yukumlulugu\"><\/span>Kira S\u00f6zle\u015fmesindeki \u00d6deme Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Kira s\u00f6zle\u015fmesi, taraflar aras\u0131nda kar\u015f\u0131l\u0131kl\u0131 bor\u00e7 ve y\u00fck\u00fcml\u00fcl\u00fck do\u011furan, ba\u011flay\u0131c\u0131 bir \u00f6zel hukuk s\u00f6zle\u015fmesidir. Kirac\u0131n\u0131n kira bedelini \u00f6demesi, s\u00f6zle\u015fmenin varl\u0131k nedenidir. Bu \u00f6deme; ayl\u0131k, \u00fc\u00e7 ayl\u0131k ya da y\u0131ll\u0131k periyotlarla yap\u0131labilir ve taraflarca belirlenmi\u015f \u00f6deme tarihi esas al\u0131n\u0131r. E\u011fer b\u00f6yle bir tarih belirtilmemi\u015fse, TBK madde 314 uyar\u0131nca, kira her ay\u0131n sonunda ve en ge\u00e7 kira s\u00fcresinin bitiminde \u00f6denmelidir.<\/p>\n\n\n\n<p>\u00d6demelerin banka kanal\u0131yla yap\u0131lmas\u0131, uyu\u015fmazl\u0131k h\u00e2linde kiraya verenin lehine delil te\u015fkil eder. Bu nedenle, s\u00f6zl\u00fc \u00f6deme beyanlar\u0131ndan ziyade yaz\u0131l\u0131 belgeyle ispat edilebilecek \u00f6demeler tercih edilmelidir.<\/p>\n\n\n\n<h2><span class=\"ez-toc-section\" id=\"Kira_Borcunun_Odenmemesi_Hangi_Hallerde_Tahliyeye_Yol_Acar\"><\/span>Kira Borcunun \u00d6denmemesi Hangi Hallerde Tahliyeye Yol A\u00e7ar?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Kirac\u0131n\u0131n \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ihlal etmesi farkl\u0131 senaryolarla ortaya \u00e7\u0131kabilir. \u0130\u015fte tahliye davas\u0131n\u0131 g\u00fcndeme ta\u015f\u0131yan ba\u015fl\u0131ca durumlar:<\/p>\n\n\n\n<h3><span class=\"ez-toc-section\" id=\"1_Surekli_Gecikmeli_ya_da_Hic_Yapilmayan_Odemeler\"><\/span>1. S\u00fcrekli Gecikmeli ya da Hi\u00e7 Yap\u0131lmayan \u00d6demeler<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Kirac\u0131n\u0131n kira \u00f6demelerini s\u00fcrekli geciktirmesi ya da uzun s\u00fcre boyunca hi\u00e7 kira \u00f6dememesi, kiraya veren a\u00e7\u0131s\u0131ndan tahliye davas\u0131 a\u00e7mak i\u00e7in ge\u00e7erli bir neden olu\u015fturur. Bu durum, s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k te\u015fkil eder.<\/p>\n\n\n\n<h3><span class=\"ez-toc-section\" id=\"2_Noter_veya_Icra_Yoluyla_Gonderilen_Ihtarin_Sonucsuz_Kalmasi\"><\/span>2. Noter veya \u0130cra Yoluyla G\u00f6nderilen \u0130htar\u0131n Sonu\u00e7suz Kalmas\u0131<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Kiraya verenin noter ya da icra kanal\u0131yla kirac\u0131ya yaz\u0131l\u0131 bir ihtarname g\u00f6ndermesi ve bu ihtarda 30 g\u00fcnl\u00fck bir s\u00fcre vererek \u00f6deme talebinde bulunmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Bu s\u00fcre sonunda herhangi bir \u00f6deme yap\u0131lmamas\u0131 durumunda, tahliye davas\u0131 a\u00e7\u0131labilir.<\/p>\n\n\n\n<h3><span class=\"ez-toc-section\" id=\"3_Icra_Takibi_ile_Gonderilen_Odeme_Emrine_Ragmen_30_Gun_Icinde_Borcun_Odenmemesi\"><\/span>3. \u0130cra Takibi ile G\u00f6nderilen \u00d6deme Emrine Ra\u011fmen 30 G\u00fcn \u0130\u00e7inde Borcun \u00d6denmemesi<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>\u0130cra ve \u0130flas Kanunu\u2019nun 269. maddesi gere\u011fi, kiraya veren icra takibi ba\u015flatarak kirac\u0131ya \u00f6deme emri g\u00f6nderebilir. Kirac\u0131, bu \u00f6deme emrini ald\u0131ktan sonra 30 g\u00fcn i\u00e7erisinde borcunu \u00f6demezse veya borca itiraz etmezse, tahliye talebiyle dava yoluna gidilebilir.<\/p>\n\n\n\n<h3><span class=\"ez-toc-section\" id=\"4_Iki_Hakli_Ihtar_Nedeniyle_Tahliye\"><\/span>4. \u0130ki Hakl\u0131 \u0130htar Nedeniyle Tahliye<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Belki de en dikkat \u00e7eken y\u00f6ntemlerden biri \u201ciki hakl\u0131 ihtar\u201d uygulamas\u0131d\u0131r. TBK madde 352 uyar\u0131nca, bir kira y\u0131l\u0131 i\u00e7inde kirac\u0131ya iki kez kira borcunu zaman\u0131nda \u00f6dememesi nedeniyle hakl\u0131 ihtar \u00e7ekilmi\u015fse, d\u00f6nem sonunda kiraya veren tahliye talebiyle mahkemeye ba\u015fvurabilir. Bu ihtarlar\u0131n noter yoluyla yap\u0131lmas\u0131, usul ekonomisi a\u00e7\u0131s\u0131ndan hayati \u00f6neme sahiptir.<\/p>\n\n\n\n<h2><span class=\"ez-toc-section\" id=\"Tahliye_Davasi_Dilekcesi_Nasil_Hazirlanir\"><\/span>Tahliye Davas\u0131 Dilek\u00e7esi Nas\u0131l Haz\u0131rlan\u0131r?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Her hukuki s\u00fcre\u00e7 gibi tahliye davas\u0131n\u0131n da temel ta\u015f\u0131 \u201cdilek\u00e7edir\u201d. Dava dilek\u00e7esi, yaln\u0131zca hukuki bir metin de\u011fil; ayn\u0131 zamanda iddian\u0131n temelini olu\u015fturan, delillerle desteklenmi\u015f resmi bir ba\u015fvuru belgesidir. Dolay\u0131s\u0131yla dilek\u00e7enin i\u00e7eri\u011fi, ba\u015fvurunun kaderini tayin edebilir.<\/p>\n\n\n\n<h3><span class=\"ez-toc-section\" id=\"Dilekcede_Bulunmasi_Gereken_Zorunlu_Unsurlar\"><\/span>Dilek\u00e7ede Bulunmas\u0131 Gereken Zorunlu Unsurlar<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul>\n<li><strong>Mahkeme Ba\u015fl\u0131\u011f\u0131:<\/strong> Hangi mahkemeye ba\u015fvuruluyorsa, \u00f6rne\u011fin \u201c\u0130stanbul Anadolu 5. Kirac\u0131n\u0131n savunmas\u0131 al\u0131n\u0131r, deliller de\u011ferlendirilir ve hakimin takdirinde bir karar verilir.<\/p>\n\n\n\n<h3><span class=\"ez-toc-section\" id=\"Olasi_Mahkeme_Kararlari\"><\/span>Olas\u0131 Mahkeme Kararlar\u0131<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul>\n<li>Kirac\u0131n\u0131n tahliyesine karar verilebilir.<\/li>\n\n\n\n<li>Tahliye yan\u0131nda \u00f6denmeyen kira borcu i\u00e7in tazminata h\u00fckmedilebilir.<\/li>\n\n\n\n<li>Baz\u0131 durumlarda davan\u0131n reddine karar verilebilir (\u00f6rne\u011fin, ihtar s\u00fcresi usul\u00fcne uygun de\u011filse).<\/li>\n<\/ul>\n\n\n\n<h2><span class=\"ez-toc-section\" id=\"Zorla_Tahliye_ve_Uygulama_Asamasi\"><\/span>Zorla Tahliye ve Uygulama A\u015famas\u0131<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Tahliye karar\u0131 kesinle\u015ftikten sonra, kirac\u0131 m\u00fclk\u00fc tahliye etmezse icra m\u00fcd\u00fcrl\u00fc\u011f\u00fc arac\u0131l\u0131\u011f\u0131yla zorla tahliye i\u015flemi ba\u015flat\u0131labilir.
